1)PalaceJobs.com使用條款及細則的確認

PalaceJobs.com所有提供的服務的所有權和運作權歸屬PalaceJobs.comPalaceJobs.com提供的服務將完全按照其發佈的章程、使用規則和操作規則嚴格執行。會員使用PalaceJobs.com所有提供的服務,即表示完全同意並接受所有使用條款及細則。& lt;span lang="EN-US">

2)使用條款及細則的修改

PalaceJobs.com 持有修改使用條款及細則的決定及執行權,PalaceJobs.com使用條款及細則一旦發生重大變動,將會在重要的頁面上提示修改內容。如果不同意所改動的內容,會員可以主動取消獲得的網絡服務。如果會員繼續使用網絡服務及專業顧問服務,則視為接受使用條款及細則的變動。PalaceJobs.com保留隨時修改或中斷服務而不需事先知會會員的權利。< span lang="EN-US">PalaceJobs.com行使修改或中斷服務的權利,亦不需對會員或第三方負責。有關最新的條款及細則,會員可隨時進www.palacejobs.com< /span>查閱。

3)註冊義務及個人資料

會員必須確保閣下所提供給PalaceJobs.com的資料均是確實無誤,絕對真確。那些資料包括但不限於< span lang="EN-US">"個人資訊""履歷表"、招聘廣告、廣告及公司資料等等。會員必須確定所有申報或提供的資料為會員本人或所屬公司所有,而所提供的資料亦不包含刻意誤導、偽造或隱瞞的內容或用詞。倘PalaceJobs.com有合理的理由相信會員所提供之資料為並非真實或非屬於該會員時,PalaceJobs.com將保留即時刪除該等資料及追究任何因會員刻意誤導、偽造或隱瞞而造成的任何損失的權利。而會員亦必須擔保任何因閣下提供假資訊而造成的法律責任。(:如對雇主提供虛假或偽造的個人資料,乃是不誠實的行為,會有可能負上法律責任。< span lang="EN-US">)

4)會員帳號

當你一旦成功登記成為會員,PalaceJobs.com便會給予會員一個登入賬號及密碼,之後,會員將對以其賬號進行的所有活動和事件(包括會員之登入賬號及密碼 的保密)負全責。當會員的密碼或帳號遭到未獲授權的使用,或者其他任何安全問題發生時,會員須立即通知PalaceJobs.com,而且,當每次終止與 PalaceJobs.com的連線時,會員必須從PalaceJobs.com登出。如會員因未能遵守本項規定所衍生之任何損失或損害,& lt;span lang="EN-US">PalaceJobs.com一概不會負上任何責任。

5)對會員信息的儲存和限制

PalaceJobs.com不對會員所發佈信息的刪除或儲存失敗負責。PalaceJobs.com有判定會員的行為是否符合PalaceJobs.com使用條款及細則的要求和精神的保留權利,如果會員違背了使用條款及細則的規定,PalaceJobs.com持有中斷對其提供網絡服務的權利。

6)對會員所提供的資料之應用

7)使用者規則

會員必須單獨承擔發佈內容的責任。而所有會員必須遵守下列各項﹕

  • 不會使用網絡服務不作非法或非認可的商業用途。
  • 確保會員資料的真確性為真實無誤,亦不會提供任何非真實性的資料。
  • 不干擾、混亂、攻擊或損害網絡服務。
  • 不利用自動程式在留言版上濫發或大量張貼訊息。
  • 不發放任何含有侵犯他人合法權利的內容,例如具誹謗性或使用者在未經允許使用的情況下擅自張貼他人的內容或文章。
  • 不發表任何非法的、騷擾性的、中傷他人的、辱罵性的、恐嚇性的、傷害性的、粗俗的及淫穢等信息資料。
  • 不發表任何教唆他人構成犯罪行為的資料﹔
  • 不發表任何涉及國家安全的資料或任何不符合當地法規、國家法律和國際法律的資料。
  • 不可利用PalaceJobs.com所提供之服務,將設計目的在於干擾、破壞或限制任何電腦軟體、硬體或通訊設備功能之電腦病毒或其他電腦代碼、檔案和程式之任何 資料,加以上載、張貼、發送電子郵件或以其他方式傳送。更不可對PalaceJobs.com的運作系統試圖進行或作出任何形式的干擾、影響或欄截。& lt;span lang="EN-US">
  • 合理地遵守所有使用網絡服務的網絡協議和規定。

若會員的行為不符合上述的使用規則,PalaceJobs.com將作出獨立判斷而取消會員的服務帳號。會員需對自己在網上的行為承擔法律責任。會員若在 PalaceJobs.com上散佈和傳播反動、色情或其他違反國家法律的信息,< span lang="EN-US">PalaceJobs.com的系統記錄有可能作為會員違反法律的證據。

此外,會員必須知道,任何人在PalaceJobs.com的版面上或留言版上發佈垃圾信息、非法廣告或發佈文章與主題內容毫不相關的文章。PalaceJobs.com版主有權在不通知作者的情況下立即刪除,並保留對作者作出警告的權利,若警告無效或嚴重違反以上規定的人將可能被查封IP地址。

8)保障

會員同意保障和維護PalaceJobs.com全體成員的利益,負責支付由會員在超出服務範圍的使用而引起的所有訴訟費用,違反使用規則的損害補償費用及一切有關的法律和賠償費用。

9)會員權利

會員在享用PalaceJobs.com所提供的服務時,擁有以下的權利

  • 會員可以隨時查閱及更改其個人資料。
  • 會員可以隨時終止PalaceJobs.com的服務,唯必須經過書面通知。PalaceJobs.com並不會對其收取任何手續費用。
  • 會員可以自由參與由PalaceJobs.com或其合作機構所舉辦的會員活動。
  • 會員可不定期收到由PalaceJobs.com或其合作機構所提供的商業優惠,但PalaceJobs.com並不會對該等優惠作出任何類型的保証或承擔。

10)有限責任

PalaceJobs.com 不會因為任何直接、間接、偶然及特殊的損害負上責任,這些損害可能來自﹕不正當使用網絡服務、非法使用網絡服務或會員傳送的信息有所變動。會員須明確了解 並同意,基於以下原因而造成之損失,包括但不限於應用、利潤、商譽、資料損失或其他無形損失,PalaceJobs.com不承擔任何直接、間接、附帶、特別、衍 生性或懲罰性賠償(即使PalaceJobs.com已被告知前開賠償之可能性亦然)

  • 本服務之使用或無法使用,
  • 經由或透過本服務購買或取得之任何商品、資料、資訊或服務,或接收之訊息,或進行之交易所衍生之替代商品及服務之購買成本,
  • 會員的傳輸或資料遭到未獲授權的存取或變造,
  • 本服務中任何第三人之聲明或行為,或
  • 本服務其他相關事宜。

11)免責聲明

會員必須清楚了解並同意以下聲明:

  • 會員須自己負擔因使用PalaceJobs.com的服務所引致的風險或損害。PalaceJobs.com的服務係依"現況""現有"的基礎提供。
  • PalaceJobs.com不保証下列事項:
    1. 本服務必須符合所有會員的個人的要求,
    2. 本服務不受干擾、能及時提供、絕對安全可靠或不會出錯,
    3. 由本服務之使用而取得之結果為正確或可靠,
    4. 會員經由本服務購買或取得之任何產品、服務、資訊或其他資料必將符合會員的期望。
  • 會員從PalaceJobs.com或經由其服務取得之任何資訊和產品,無論其為書面或口頭,絕不構成本服務條款未明示規定之任何保証。
  • PalaceJobs.com不會對其的任何服務作出任何形式的擔保(不論明示或暗示),包含但不限於商業適售性、特定目的之適用性及未侵害他人權利。

 

 

 

 

Terms and Conditions

This web site of Palace Personal Consultant Company ("Company") and any other site of the Company accessed through this site (collectively "Web Site") and the services provided therein shall only be available to user seeking employment ("Jobseeker") or user seeking employees or advertisers and be subject to the Privacy Statement and the Terms and Conditions (which are set out below). If you do not accept either or both the Privacy Statement and the Terms and Conditions, please do not use the Web Site. Upon your acceptance of the Privacy Statement and the Terms and Conditions, the Terms and Conditions shall be binding upon you. The Company may revise the Privacy Statement and the Terms and Conditions at anytime without prior notice. You are advised to periodically review the Privacy Statement and the Terms and Conditions. Your access to the Web Site and the Company's services will be terminated upon your notice to the Company that any change is unacceptable; otherwise your continued use shall constitute your acceptance of all changes and they shall be binding upon you.

1.      Acceptable Web Site Uses

a.       Specific Uses - Jobseeker

Jobseeker agrees that he/she shall only use the Web Site for lawful purposes and seeking employment. Jobseeker may send his/her resume directly to any Employer who advertises on or through the Web Site. Alternatively, Jobseeker may send his/her resume to the Company through the Web Site in reply to any job advertisement. In such event, Jobseeker's resume will also remain active on the Web Site and be stored in the Company's database at his/her own risk unless and until he/she chooses to delete it. Jobseeker acknowledges and agrees that his/her resume may be accessed by employer who has subscribed to the services of the Company for the sole purpose of obtaining and assessing the suitability of Jobseekers ("Employer"). The Company also reserves the right to edit any Jobseeker's resume as it sees appropriate to achieve the purpose stated herein and to erase any personal data which the Company reasonably believes that such data are inaccurate having regard to the purpose (including any directly related purpose) for which the data are or are to be used.

Jobseeker acknowledges and agrees to the Company's practice of charging Employer a fee for access to the Web Site, database ("Database") and Jobseekers’ resumes and details ("Resumes") for the sole purpose of obtaining and assessing the suitability of Jobseekers and subject to the terms herein. Jobseeker also recognizes that he/she shall have no claims to any such fee received by the Company. The Company will not release Jobseeker's personal data to any Employer without his/her permission. Jobseeker also acknowledges and agrees that the Company will release his/her brief resume (without his/her name, address and other personal identifiable information) to Employer through the use of the Company's search engine or any other means for the sole purpose of obtaining and assessing the suitability of Jobseekers in relation to any job vacancy. However, Jobseeker agrees that the Company and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential employers or Employers, their respective agents or anyone under their employ.

The Company will not be responsible or held liable in any way if any Employer, in breach of the Terms and Conditions, whether in Hong Kong or elsewhere, use the Jobseeker's personal data for any use other than for obtaining potential employees. Jobseeker accepts that personal data given to Employer or other users are given entirely at his/her own risk. Also, the Company reserves the right to terminate any services to any Jobseeker should it become aware of any breach by any Employers and/or Jobseekers.

b.      Specific Uses - Employer

Upon payment of the service fee to the Company or upon acceptance of any free trial promotion offer, Employer will be entitled to use the Web Site to advertise job vacancies and/or create their own web page on the Web Site for a predetermined period following agreement of the predetermined service, save and except for free trial promotional offer. Employer will also be entitled to access the Database but agrees that all information obtained shall only be used for the sole purpose of obtaining and assessing the suitability of Jobseekers. Employer acknowledges and agrees that it shall disregard any personal data received from Jobseeker which are irrelevant to obtaining and assessing the suitability of candidates. Employers shall be solely responsible for the contents and materials contained in its advertisement and/or web page.

The Company reserves the right to edit any advertisement or web page as it sees appropriate to achieve the purpose stated herein. The Company shall have the right to terminate any services to any Employer and remove any advertisement posted on the Web Sites at the Company's sole discretion, without any compensation or recourse to the Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the provisions herein; whereas, in the event that the Company decides to remove an advertisement for any reasons not relating to any breach of the provisions herein, the Company may after deducting the fees charged for the period that the advertisement has been posted on the Web Site, refund the remaining fees (if any) to the Advertisers. The Company also reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any Employer fails to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the Employer's web page or advertisement, without prejudice to all other rights and remedies.

c.       Prohibited Uses - Jobseekers and Employers

Jobseeker and Employer agree not to use the Web Site for any of the following purposes which are expressly prohibited :-

                                                        i.            Jobseeker shall not post any non-resume related information and/or incomplete, false or inaccurate resume related information.

                                                      ii.            Jobseeker shall not respond to any employment opportunity for any reason other than to apply for the job advertised and Employer shall not respond to any Jobseeker other than in connection with his/her application for a job. Communications soliciting business for any reason is prohibited.

                                                    iii.            All users shall not print, download, duplicate or otherwise copy or use any personally identifiable information about other users save and except the Database or/and Resumes accessed by the Employer pursuant to Clause 1.a. as above. All unsolicited communications of any type to users is strictly prohibited.

                                                    iv.            All users shall not delete or revise any material posted by any other person or entity.

                                                      v.            All users are prohibited from violating or attempting to violate the security of the Web Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil and/or criminal liabilities.

                                                    vi.            All users shall not use the Web Site for transmitting, distributing or storing material in violation of any applicable law or regulation, or in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.

2.      Copyright, Trademarks etc.

The graphics, images, editorial content and HTML on the Web Site are the intellectual property of the Company and are protected by copyright and trademark laws and may not be downloaded or otherwise duplicated without the express written permission of the Company. Re-use of any of the foregoing is strictly prohibited and the Company reserves all rights.

3.      Responsibility

The Company may not monitor its Web Site at all times but reserves the right to do so. The Company takes no responsibility whatsoever for any material input by any user or others and not posted by the Company. All users acknowledge and agree that they are fully responsible for the form, content and accuracy of any resume, advertisement, web page or material contained therein placed by them (as the case may be). The Company shall not be responsible for the content of any other web sites linked to the Web Site; links are provided as Internet navigation tools only. The Company does not warrant that any resume, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. The Company shall not in any way be considered an agent of either Employer or Jobseeker with respect to any use of the Web Site. The Company shall not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on the Web Site. WHILST THE COMPANY HAS ENDEAVOURED TO PROVIDE A QUALITY SERVICE TO EMPLOYERS AND JOBSEEKERS, IT DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL MECHANISMS. IF USE OF THE WEB SITE OR ITS CONTENTS RESULT IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, BY ANY USER, THE COMPANY SHALL NOT BE RESPONSIBLE FOR THOSE COSTS AND ANY LOSS AND DAMAGE OF WHATSOEVER NATURE. THE WEB SITE AND ITS CONTENTS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT PREJUDICE TO THE FOREGOING, ANY IN RESPECT OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, FITNESS FOR PARTICULAR PURPOSE, OR ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF THE CONTENTS, SERVICES, SOFTWARE, TEXT, GRAPHICS AND LINKS OF THE WEB SITE.

4.      Own Risk

All USERS USE THE WEB SITE AND ANY OTHER WEB SITES ACCESSED THROUGH IT, AT ENTIRELY THEIR OWN RISK. ALL users shall be responsible for their own communications and are responsible for the consequences of their posting. The Company does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorse any opinions expressed by users. Any reliance by users on material posted by other users shall be at their own risk. The Company reserves the right to expel any users and prevent their further access to the Company's Web Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate in the Company's sole discretion.

5.      Links to Other Sites

The Web Site may contain links to third party web sites. These are provided solely as a convenience to you and not in any way as an endorsement by the Company of the contents on such third-party web sites. If users access any linked third party web sites, they do so entirely at their own risk. The Company shall not be responsible for the contents of any third party web sites linked to the Web Site and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party web sites. Further any material or details posted in the Web Site by any user may be viewed by users of other web sites linked to the Web Site and the Company shall not be responsible for any improper use by any user or third party from linked third party web sites of any data or materials posted on the Web Site.

6.      Indemnity

All users agree to indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the Web Site or their breach of the terms of this Agreement. The Company shall provide prompt notice of any such claim, suit or proceeding to the relevant user.

7.      Disclaimer

THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS SHALL NOT BE LIABLE IN ANY EVENT FOR ANY LOSSES OR DAMAGES SUFFERED BY ANY USERS WHATSOEVER DIRECTLY OR INDIRECTLY ARISING OR RESULTING FROM THEIR USE OR INABILITY TO USE THE WEB SITE AND ITS CONTENTS.

8.      Limitation of Liability

Without prejudice to the above and subject to the applicable laws, the aggregate liability by the Company to any user for all claims arising from their use of the Company's services and the Web Site shall be limited to the amount of the existing package fee subscribed to and paid for by the user (if any) and operative at that time.

9.      Security Measures

The Company will use its reasonable endeavours to ensure that its officers, directors, employees, agents and/or contractors will exercise their prudence and due diligence in handling the personal data submitted by Jobseekers and the access to and processing of the personal data by such persons is on a "need-to-know" and "need-to-use" basis. The Company will use its reasonable endeavours to protect the personal data against any unauthorized or accidental access, processing or erasure of the personal data.

10.  Governing Law and Jurisdiction

This agreement and any dispute or matter arising from or incidental to your use of the Web Site shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China ("Hong Kong") and both you and the Company submit to the exclusive jurisdiction of the courts of Hong Kong.
